制度根基、制度缺陷和制度修复——对“导弹及其技术控制制度”的理论思考

MTCR的创立 ,是国际社会努力遏制导弹扩散的开端。MTCR有制度规制、技术禁运、政治压力和扩散推定四大制度根基。MTCR的制度根基存在先天缺陷 ,制约其功效的充分发挥 ,需要必要的制度修复。MTCR的前景是在超越自身的基础上 ,建立类似于核不扩散机制 (NPT)的全球导弹防扩散条约机制。

Institutional Groundwork,Institutional Limit and Institutional Remedy: A Theoretical Thinking of “Missile Technology Control Regime” (MTCR).

The foundation of MTCR is the beginning of containing missile proliferation in international community. MTCR has four institutional groundwork including institutional criterion, technology ban, political pressure and proliferation deduction. Institutional groundwork of the MTCR has innate flaws, which restrict its function and need necessary remedy. The prospect of the MTCR will be the breaking away from its present framework and the building of a Global Missile Nonproliferation Treaty Regime as the NPT.
