论现行刑罚结构的立法完善

随着人类文明的发展、人权意识的增强和刑罚人道性的认同,世界各国刑罚结构趋轻化的改革已成为主流。我国刑罚结构是以死刑和监禁刑为主导的重刑刑罚结构,这妨碍了刑罚功能的有效发挥。减少死刑、完善自由刑、提高罚金刑地位和增设相关刑种应是我国刑罚结构完善的方向。

On Legislation Perfection of Current Penalty Structure

With the development of human civilization,awareness of human rights and recognition of humanity of penalty,the reform of penalty structure of all the countries in the world on lighter punishment has increasingly become mainstream.China＇s penalty structure is the felony penalty structure which dominated by the death penalty and sentence of imprisonment,this hinders the penalty function effectively.To reduce death penalty,improve freedom penalty,increase criminal fines and add related species of criminal penalty should be the direction of perfection of China＇s penalty structure.
