浅析油气资源勘探开发环境影响评价与矿业权管理

环境影响评价是石油公司进行油气资源勘探开发需要完成的重要工作之一,油气资源勘探开发环境影响评价批复是油气矿业权审批的要件之一,也是油气矿业权审批的重要依据。本文通过梳理我国油气资源环境影响评价的法律法规,分析油气资源勘探开发环境影响评价的特点,结合油气矿业权审批的特点总结出当前管理制度下存在的动态环境影响评价与矿业权审批之间的矛盾、矿业权审批对环境影响评价的规定不全面、环境影响评价管理特点不能满足矿业权管理需求等方面问题,依据存在的问题提出以下针对性建议:进一步简政放权,取消环境影响评价审批与矿业权审批的"捆绑"关系;加强部门协调,推动环境影响评价管理改革;运用"互联网+",建立信息共用共享;转变管理思路,改革油气矿业权管理制度。旨在进一步促进油气资源勘探开发环境影响评价与油气矿业权管理的契合度,完善油气矿业权管理制度,简化办事流程,减轻矿业权人负担。

Research on the Management Mode of China

Environmental Impact Assessment (EIA) is one of the most important tasks for oil and gas companies to do when they explore the oil and gas. It is one of the important factors for the approval of oil and gas mining rights, and also an important basis for the approval of oil and gas mining rights. By enumerating the laws and regulations on EIA of oil and gas resources in China, analyzing the characteristics of EIA of oil and gas exploration and development, combining the characteristics of the examination and approval of oil and gas mining rights, this paper sums up several problems, such as the contradictions between the dynamic environmental assessment and the examination and approval of mining rights under the current management system, the provisions of the examination and approval of mining rights on the environmental assessment are not comprehensive, and the characteristics of the environmental assessment management cannot meet the needs of mining rights management. Based on the problems, the following suggestions are made: (1) further decentralization, abolition of the "binding" relationship between the EIA approval and the approval of mining rights; (2) strengthening the coordination of departments and promoting the EIA management reform; (3) building the sharing of information by using the "Internet plus"; (4) changing management methods and reforming the management system of oil and gas mining rights. The purpose is to further promote the integrating degree of the environmental impact assessment of oil and gas resources exploration and development and the management of oil and gas mining rights, improve the management system of oil and gas mining rights, simplify the process, and reduce the burden of mining owners.
