基于制度功能理论的中国矿产资源产权制度改革研究（增刊）

本文通过分析总结关于矿产产权制度的相关文献,对我国矿产产权制度改革的研究进展进行了详细的梳理。国内学者的主流观点是在坚持矿产资源国家所有的基础上,对矿产产权关系、内容进行明晰等,也存在一些学者认为明晰的、正式的产权制度并非意味着资源利用的高效、低的社会纠纷和经济效益的增加。本文在评析了相关产权制度改革文献的基础上,认为产权制度改革应首先从产权制度的功能入手,并对今后此方面研究进行了展望。

Reconsidering China

This paper reviews the literature on the property rights of mineral resources in China and provides a detailed analysis of the latest developments in property rights. The mainstream view of domestic scholars favors the state ownership of mineral resources and emphasizes that property rights should be clear and secure. However, a certain number of scholars believe that clear and formal property rights institution are not necessarily tantamount to an efficient use of resources, a low level of social conflict, and increased economic benefits. Through an examination of relevant literatures on the reform of mineral resources we suggest that the reform should first consider the function of institutions. We believe that this approach should form the basis for future research perspectives.
