论城市规划的公共政策导向与依法行政

讨论城市规划的公共政策导向与依法行政的关系。宏观层面的、战略性阶段的规划,要突出政策性,清晰表述具体的政策目标和要求;实施性的规划,其主要属性应是“地方性法规”或“公共契约”。另一方面,城市规划施行与公共行政是密切联系在一起的,因而在城市规划的行政管理层面,要使既定的公共政策“制度化”,从而为“依法行政”提供前提条件。

ON PUBLIC POLICY ORIENTED URBAN PLANNING AND ADMINISTRATION ACCORDING TO LAW

This paper discusses the relationship between public policy oriented urban planning and adminstration according to law. It is argued that the perspective and strategic planning should focus on policy consideration by specifying policy targets and requirements,whereas implementary planning should be local regulations or common agreements. On the other hand,The planning implementation by nature is the pubic administration,which requires the legal base. Therefore the institutionalization of public policy in the urban planning administration is necessary.
