虚假信息微传播的刑法规制

当前，基于移动互联网的微博、微信、微视频等微应用已经成为主流的传播方式，并且逐渐延伸到政务领域，在方便社会公众及时获取信息的同时，也存在着严重危害社会秩序和国家利益的虚假信息的大量传播现象。《刑法修正案（九）》中增加“编造、传播虚假信息罪”，有利于改变针对传播虚假信息以“寻衅滋事罪”等为罪名的刑事制裁体系。但是在增设新罪名的同时，应当考虑其罪名在量刑设置上与其他虚假信息犯罪量刑设置上的协调，也应当在此基础上增加罚金刑，以体现虚假信息制裁体系上的宽严相济的刑事制裁理念。

At present,the application based on the mobile Internet such as weibo,WeChat,micro video is popular and has become a mainstream means of dissemination and quickly extends to government affairs.This means of dissemination facilitates public access to information in a timely manner,but also there is a serious threat to social order and national interests with a large number of dissemination of false information.The Criminal Code Amendment (nine)increases “crime of fabricating, dissemination of false information”,and helps to change charges for the criminal sanction system against the dissemination of false information to “crime of affray”.The Code on the creation of new charges could be considered in sentencing while char-ges on the set of coordination with other false information on criminal sentencing set,and can increase the fine penalty.The way can be seen to false information on the system of sanctions and criminal sanctions idea of temper justice with mercy.
