解析融资租赁法草案完善我国现代租赁业

我国《融资租赁法》(草案)已基本起草完毕,不久将提交全国人大讨论通过。该草案填补了我国融资租赁领域中的法律空白,为发展我国融资租赁业创造了良好的法律环境。但要把我国现代租赁业真正发展成为配置信贷资源、设备资源、服务资源、人力资源和促进企业、国民经济可持续发展的新型资产管理服务行业,在法律上仍需进一步规范和完善。为此,借鉴发达国家现代租赁业的成功经验,结合我国国情从立法角度进行了初步探索,并提出了一些具体建议。

Analyze the Margin Leasing Method Drafted Plan to Perfect Modern Leases Industry in Our Country

"The margin lease method"(drafted plan)has already been drafted and completed and it will be handed over to National Peoples Congress for discussion and passing in 2007.It will fill up our country's margin leasing law blank and create good law environment for development of margin leasing industry.But if we want our country's modern leasing industry to be really developed and to become the new service and management industry to allocate loan resources,equipments resources,service resources,human resource and help the business enterprise,national economy to keep on developing,we still need further norm on the law with perfect.Therefore,the author of this paper draws lessons of modem successful experience of leasing industry from developed countries,combines our country's real situation,carries on first step approach from the lawmaking angle,and puts forward some concrete suggestions.
