被执行主体变更类型与程序的若干问题

变更被执行主体是民事强制执行程序中的重要司法活动，关系到案外人是否承担实体法律义务以及权利人的权利能否顺利实现。司法实践中，原被执行主体消亡所产生的法律后果各异，其权利义务继受人是否要承担实体上的法律义务以及如何承担应区别对待。由于立法的滞后，实务界在处理涉及被执行主体变更问题的案件时无章可循，操作不一，有必要加以规范。

The variation of the excuted corpus is a very important judicial action during the civil enforcement proceeding.Which respects whether the thirty party should undertake the substantive obligation and the obligee can get his right.In the judicial execution,the extinguishments of the excuted corpus would bring different lawful sequences.Should the successor undertake the substantive obligation and how should he do itWe should make difference between them.The bailiff always feel that there aren't the union merits during their doing with the cases which respect to the variation of the excuted corpus due to lagging of enactment.It is neccessrary to standard operation.
