| 摘 要： | “无讼”文化产生的经济基础是自给自足的小农经济，宗法家族制度是其社会基础，儒家思想是其理论基础，行政兼司法、民刑不分的司法制度是其法律基础，建立和巩固中央集权的君主专制制度是“无讼”文化的起点和归宿，而古代的调解制度又为消弥诉讼提供了一个解决纠纷的机制。

| Abstract: | In this article,the author has explained the formation reasons of mon-litigation legal culture,which include peasant economy,family social system,confucian ideology,jurisdiction subject to administrative power legal system.The ultimate aim and end are for the centralized despotic political system.Although the Chinese legal culture is a non-litigation one,the disputes between different parties are usually settled by mediation in ancient China. |
