对环境权的再审视——以“人类-自然”环境系统为视角

自环境权理论在我国提出以来,关于环境权的各种主张纷争迭起。从统合人的自然属性和社会属性的＂人类—自然＂环境系统来看,环境权实际上是一种具有层次性的综合性权利,通过人对环境的直接支配关系、环境在人与人之间的间接分配关系和人类与环境的互动关系可体现出来。环境关涉整个人类的利益,环境权体现了人类利益的共同性,而＂人类—自然＂环境系统中环境权的发展趋势之最终路径是宪法化。
