| 摘 要： | 当前我国侦查程序存在的种种弊端日益凸现,已经逐步异化为一种"恶"的工具。侦查异化是多个因素作用的结果,但检警关系的失范是其重要一级。应当结合本土状况重塑检警关系,架构"检察指导侦查"制度,彰显刑事诉讼的公平和效率价值。

| Abstract: | At present various malpractices in crime-investigating procedures in China are protruding day and day and have been gradually alienated to a "evil" instrument.Such alienation is caused by a great many factors,among which a normalization of relations between procurators and police is an important one.What we should do is(to) remold,on the basis of conditions of our native land,relations between the two side above,construct a system in the light of which the procurator organ should guide investigations and put emphasis on the fairness and efficiency of criminal suits. |
