基于TRIZ的专利群规避方法研究与应用

摘    要:目前专利规避设计主要是针对单一专利进行规避设计,然而单一专利规避设计只可规避特定的专利,规避结果仍然有侵犯该专利群中其它专利的风险。因此,集成TRIZ(teorija rezhenijia inzhenernyh zadach,发明问题解决理论)创新方法与专利群规避方法,提出一种系统化的专利群规避方法,用于产品创新设计。首先,通过关键词和IPC(international patent classification,国际专利分类)的布尔运算检索确定目标专利群;然后,通过TRIZ方法中的库组件将专利群中的各个专利联系起来,并通过组件-功能分析建立专利群总功能模型图来确定需规避的问题;接着,应用组件规避、功能规避以及TRIZ创新方法来获取初步解决方案,并进行专利侵权判定及专利组合申请;最后,以某公司玉米脱粒机专利群为实例,应用提出的方法进行专利群规避设计,改进了玉米脱粒机并申请相关专利。结果表明改进后玉米从进料斗由螺旋送料装置送至脱粒辊处,脱粒辊上螺旋分布的脱粒刺使玉米边前进边旋转,达到脱粒效果,改进后玉米脱粒机具备破碎率低、脱净率高及工作效率高的优点。实例验证表明基于TRIZ的专利群规避方法有效实现了对已有专利群的创新规避设计。

Abstract:At present,patent circumvention design mainly aims at the circumvention design of single patent.However,a single patent can only evade specific patent,the result of such circumvention may still have the risk of infringing other patents in this patent group.Therefore,TRIZ innovation method and patent group circumvention method were integrated,and a systematic patent group circumvention method was proposed for product innovation design.Firstly,the target patent group was determined through the Boolean operation of IPC(international patent classification)and keywords.Secondly,the patents in the patent group were linked by library components in the TRIZ method,and the total function model diagram of patent group was established through component-function analysis to determine the problems to be avoided.Thirdly,component circumvention and function circumvention as well as problem innovative methods in TRIZ were applied to obtain the preliminary solution,and the patent infringement judgment and patent portfolio application were made.Finally,taking the patent group of corn thresher as an example,this method was applied to the patent group circumvention design.A improved corn thresher was developed and applied for related patents.Corn was poured into the hopper and sent to the threshing roll by the spiral feeding device.The spiral distribution of threshing thorns on the threshing roll made the corn move forward and rotate at the same time to achieve the threshing effect.Corn cobs were collected in the dreg hopper and corn grains were collected in the hopper.The improved corn thresher has the advantages of low crushing rate,high net removal rate and high working efficiency.The example shows that the patent group circumvention method based on TRIZ effectively realizes the innovative circumvention design for existing patent groups.
