适用《证据规则》存在的几个问题

《最高人民法院关于民事诉讼证据的若干规定》,是我国民事审判证据制度改革的一重大成果。在其适用过程中,仍然存在着不少问题。从当事人的举证责任能力、当事人调取证据及证人作证的机制保障、证据交换、证据鉴定、举证期限等方面分析,探讨了解决这些问题的对策。

Problems in the Application of "Some Provisions of the Supreme People's Court on Producing Evidence in Civil Actions"

"Some Provisions of the Supreme People's Court on Producing Evidence in Civil Actions" is an important achievement in the reform of evidence-producing system of China in civil actions.However,there exist some problems in its application.This paper analyzes it from the aspects of the ability of the party concerned for burden proof,system guarantee for the party concerned to employ evidence and the witnessing of the witnesses,evidence exchange,evidence verification,term of producing evidence,and discusses countermeasures to solve these problems.
