| 摘 要： | 对缓刑制度进行价值分析,能够为该制度设立的合理性和必要性的评判找到标准和方向,同时对于制度的完善起到推动作用.对缓刑制度的价值分析就是对缓刑如何体现刑罚价值的分析.刑罚的终极价值是正义、秩序和自由.缓刑制度通过弥补报应刑论和预防刑论的缺陷而最终实现正义、秩序和自由.

| Abstract: | A value analysis on system of suspension of punishment,can find the critiria and the direction for the judgmentof its rationality at the same time,promote the improvement the system.The value analysis on system of suspension of punishment is actually how to manifest the penalty value.The ultimate penalty value is justice,order and freedom.The system of suspension of punishment will realize finally justice,order and freedom through making up for the flaw of the retribution and the prevention punishment. |
