中国传统医药的知识产权保护

目前我国中药面临巨大的竞争压力,一方面中药产业在国际中草药市场份额很低,另一方面国内中成药相互仿制,低水平重复大量产生,同一品种重复生产严重。在这种情势下可以通过知识产权保护界定本来无法独占收益的中药创新行为的所有权,但中药知识产权问题涉及的范围很广,其中包括专利、商标、行政保护以及商业秘密四个主要方面,而关于中药材、饮片、处方、提取物、制剂、制药工程、相关衍生产品等需要保护的内容则非常多,因此如何运用好现代知识产权制度保护中药这一中华民族的瑰宝成为目前亟待解决的问题。
