试论市场经济法制的内在精神

市场经济是法治经济,现代市场经济与现代法制是相互伴生的。在现代市场经济形成和发展的过程中,现代法制也日益成长和完备,两者彼此推动,相互为用。但是,在加快立法、加强执法的同时,市场经济法制的内在精神却日益缺失。法的精神是法律制度的灵魂和中枢神经,是整个法制系统的中心聚合点。公正作为法制所追求的永恒主题,体现了社会及市场共有的秩序化要求,体现了市场经济的功能与法制目标相对分离的要求,理应成为市场经济法制内在精神的核心要义。

Inner Spirit in Legal System of Market Economy

Market Economy is the legal economy,which was born among the mutual interaction with modern legal system.During the market economy's formation and development,it interacts and promotes with the legal system and the legal system has been perfected.But during quickening the process of legislation and enforcing the law the inner spirit in legal system of market economy has been fading.The legal spirit is the soul and central nervous system of legal system,and also the central essence of the whole law system.Justice,as the permanent theme in the law system,is supposed to be central essence of inner spirit in legal system of market economy,which can demonstrate the requirement of social and market order and also reflect the requirement of separating the function of market economy and the goal of the law system.
