| 摘 要： | 针对工程项目争议中承发包双方无法使用"其他证据"进行有效举证的问题,依据法释2004]14号第19条规定,总结可用于工程实践的"其他证据"种类和特征,对"其他证据"进行效力等级排序,并给出"其他证据"的举证策略和项目实施过程中的证据收集关键点。研究成果可为工程争议的快速解决提供可靠支撑。

| Abstract: | In view of the engineering project disputes that the parties can not use"other evidence" to effectively prove,this paper using the stipulation 19 of the Judicial Interpretation 14th 2004,analyzes the species and characteristics of the other evidences trough judicial cases,then classifies the other evidences according effective grade,finally gives the key point of evidence collection run through the whole project implement process,and the strategy of adducing evidence. The results can provide the reliable support for the rapid solution of engineering distu. |
