大数据时代我国文化创意产业知识产权保护的路径选择

大数据时代,更加凸显文化创意产业知识产权保护的重要性和紧迫性。加强知识产权保护,是营造文化创意产业发展环境的关键。当前我国文化创意产业知识产权保护存在的问题主要体现在知识产权保护意识淡薄和知识产权保护路径选择缺乏科学性两大方面。通过法律途径对我国文化创意产业知识产权进行保护是所有保护途径中的最佳选择。我国文化创意企业应当根据其自身具体实际情况,综合运用著作权、专利权、商标权、商业秘密权、反不正当竞争等多种保护手段所提供的全方位综合保护,选择最合适的知识产权保护路径,促进我国文化创意产业的健康发展。

Path Selection of Intellectual Property Protection in Cultural and Creative Industries in the Age of Big Data

This paper argues that a complete history of the development of the twentieth - century Beijing culture should connect the Late Qing Reform （1901 -1911 ） and the era of the Republic of China with the the history of the peopleg Republic of China, and only in this organic wholeness can an overall characteristics of Beijing culture be fully understood. In the period of late Qing Dynasty and the early Republic of China, even until 1936, when great changes occurred in the political, historical, economic and cultural fields, the modern transformation of Beijing culture happened and the modern form that directly influenced the Beijing culture in the whole twentieth century can trace back to the 1900s; the premise of the modernity of Beijing culture that began from the October 1949 is not adopted from the the court culture of Late Qing before 1990 but rather a Beijing culture with new social political content （the political basis of democracy and republic） , thoughts （patriotism, democracy, progress and science）, with modern form （ new cultural form） and the life practice （ a tendency of Western life style）, and it is this modern form that links new China with the Chinese feudal culture.
