| 摘 要： | "城中村"拆迁问题是我国多数大中城市在城市化过程中面临的共同问题, 目前我国城乡土地所有制二元结构和相关法律法规缺位,导致"城中村"拆迁过程中出现了很多问题.该文以秦皇岛市为例,分析了秦皇岛市"城中村"的形成原因和过程,对"城中村"拆迁改造过程中存在的"公共利益"泛化、补偿标准不明确,被拆迁主体缺乏诉权保障等法律问题进行了探讨,提出了界定"公共利益"、明确最低补偿标准,确定"城中村"居民的合同主体资格赋予其诉讼权利等意见.
