检察权科学配置问题研究

检察权是宪法赋予检察机关的权力，法律为检察机关行使检察权提供了许多保障措施，使检察权在追诉犯罪、惩治腐败、纠正违法、维护国家法律的统一、正确实施方面，发挥了重要作用。然而我国检察权的配置还存在一些问题，不仅制约了检察机关法律监督职能的充分发挥，而且制约了检察机关的发展。通过改革，完善检察权，使检察权配置更加科学合理，保障检察权充分而有效地行使，是检察制度发展的必然要求，也是推进依法治国方略的必然要求。

A Research on the Scientific Disposition of Procuratorial Power

Procuratorial power is the power endowed by the Constitution for the procuratorial organs to exercise the law and provide procuratorial power of many security measures. Procuratorial power has played an important role in the prosecution of crime, punishing corruption, rectifying the law, safeguarding national unification and correct implementation of the law. However, there are still some problems with China＇s procuratorial power configuration, which not only restrict the procuratorial organs＇ functions of legal supervision, but also frustrate their development. Reforming and perfecting the procuratorial power so as to ensure the procuratorial power disposition to be more scientific and reasonable, the safeguard is the necessary requirement for the systemic development of the procuratorial development and the inevitable demand of the legal governing of the country.
