论行政主体义务在行政法中的地位

强化行政主体义务是当代行政法治的基本格局,然而,行政主体义务的法律地位在行政法学界却鲜有阐释。为了弥补这一理论空缺,本文从行政主体义务在行政法中地位的模式选择、行政主体义务在行政法地位中的应然表现、行政主体义务在行政法治实践中存在的问题以及行政主体义务与重构行政法体系等方面对行政主体义务的理论和实践问题进行了分析。

On the Status of Obligations of the Subject of Administration in Administrative Law

To strengthen obligations of the subject of administration is basic pattern of rule of administrative law. However,the academie circle of administrative jurisprudence has rarely explained legal status of obligations of subjects of administration. In order to remedy the vacancy in theory, this article makes analysis on theoretical and practical matters of obligations of the subject of administration from such aspects as pattern choice and "ought-tobe" presentations of the status of obligations of the subject of administration in administrative law,existing problems of obligations of the subject of administration in practice of rule of administrative law, relations between obligations of the subject of administration and systems of administrative law.
