| 摘 要： | 共犯理论被学者称之为刑法学中的"迷宫",而教唆犯绝对可称之为这一"迷宫"里最为复杂和深邃的领域.由于其特殊性和特有的魅力,教唆犯问题历来是学者和实务界关注的焦点.教唆行为部分还有许多内容可以深入挖掘,对我国刑法第29条第2款"被教唆人没有犯被教唆的罪"的理解和适用还需要进一步明确.

| Abstract: | The accomplice theory is called "labyrinth" by the scholars in the field of criminal law,and the part of abettor may be the most complex and profound domain in this "labyrinth".Because of its own particularity and unique charm,the abettor is always the focus which the scholars and the practical realm pay attention to.The part of abetting still has many contents to be excavated thoroughly.The understanding and application of "the person who is instigated didn't carry on the crime",which is prescribed in the 2nd section of 29th article of the Penal Code,also needs to be cleared further. |
