法律权威与公众法律认同问题研究

法律权威以法律认同为逻辑推演的起点,而法律认同又以法律具有权威为必要条件。法律权威与法律认同的良性互动以法在社会生活中能够产生预期的法律实效为前提。法律在社会纠纷解决机制中缺乏实践权威导致公众对法律缺乏认同感,法律规范难以转化为民众公认的生活方式;公众对法律缺乏认同感、法治观念淡漠进而又削弱了法律权威。中国法治建设的当务之急乃是强化法律实践权威,提升公众法律认同感,使两者良性共契,及时摆脱目前互相弱化的恶性循环态势。

On Legal Authority and Legal Identity of the Public

Benign interaction between legal authority and legal identity is based on the premise of legal effectiveness.However,the contents of the authority differ from the practice of the authority in many ways.Because of the insufficiency of legal practice authority in social dispute-resolving mechanism,the public are short of legal identity and rules of law are difficult to be translated into the putative public practical life style.Legal authority is weakened due to the public being short of legal identity and indifferent to idea of rule by law.Enhancing practice authority is the key to government by law construction of China.It is important to bring legal authority and legal identity into positive harmony and break away from the present vicious circle.
