目的/意义] 系统分析20年来图书馆著作权侵权案件裁判文书，旨在从实务的角度为图书馆提供对策。方法/过程] 运用案例实证分析法，先从宏观角度归纳图书馆在著作权侵权纠纷中失利的具体表现，再从微观角度对具体案例进行法理分析，剖析失利的原因。结果/结论] 结果表明图书馆败诉率、法院判赔支持率以及经济赔偿金额均逐年上升，主要原因在于数字化作品在线阅读服务运作模式中图书馆往往因数据库提供商的过错而被迫承担连带责任；实务上图书馆应通过积极防范侵权、积极应对诉讼以及诉后及时追偿来保护自身利益。

The Dilemma,Causes and Countermeasures of Library Copyright Infringement from the Perspective of Civil Code

Purpose/significance] The systematic analysis of the judgment documents of library copyright infringement cases in the past 20 years aims to provide libraries with countermeasures from a practical perspective.Method/process] Using case empirical analysis method, first summarized the specific performance of the library's failure in copyright infringement disputes from a macro perspective, and then conducted a legal analysis of specific cases from a micro perspective to analyze the reasons for the failure.Result/conclusion] The results show that the library's loss rate, the rate of court's support for compensation and the amount of compensation have all increased year by year. The main reason is that in the operation mode of online reading service of digital works, libraries are often forced to bear joint liability due to the fault of the database provider. In practice, the library should protect its own interests by actively preventing infringements, actively responding to litigation, and promptly recovering after litigation.
