| 摘 要： | 水事纠纷不仅有权利纠纷,还有义务纠纷,对水事纠纷的概念不应只从权利的角度来解释。水事义务转让是与水权转让相对应的另一类水事关系转让。对其进行了简单的法律分析,对其法律依据和现行水事义务转让法治化的困难作了简要阐述,最后通过对湖南省道县向阳坝水电站的灌溉义务转让纠纷案例,进行水事义务转让的法律分析。

| Abstract: | Water disputes don＇t only contain the right disputes,but also contain the obligations disputes,the concept of water disputes should not only be explained from the right.Obligation transferring about water is another kind of relationship transferring about water,corresponding to the right transferring about water.This paper analyses it simply and legally,expounds on its legal basis and the difficult of ruling the obligation transferring about water by law.At last,the paper analysis legally the dispute case of irrigation obligation transferring about Xiangyang Dam hydropower station in Daoxian Hunan province. |
