关于徇私枉法罪若干问题的探讨

徇私枉法罪是规制刑事司法人员职权行为的重要法律规定。对徇私枉法罪的犯罪对象、犯罪行为、犯罪主体、犯罪主观方面、共犯等重要问题进行探讨,应根据徇私枉法罪司法实践与重要理论研究成果,结合全国人大常委会刑法修正案(四)的有关规定、全国人大常委会同日对渎职罪的立法解释来进行。

On Problems of the Crime of Bending the Law for the Benefit of Relative or Friends

The crime of bending the law for the benefit of relative or friends is an important legal provision for regulating the criminal judicial action. Basing on judicial practice and important theoretic and considering relevant provisions of the fourth amendments to Criminal Law and the legislative interpretation made by the standing committee of the NPC the author discusses some important problems of the crime of bending the law for the benefit of relative or friends such as criminal object, criminality, subject of crime, etc.
