诉讼侵权行为探析

诉讼侵权行为是指加害人无正当理由,通过提起民事或刑事诉讼、恶意告发、滥用诉权给诉讼中的一方当事人造成一定损害,或者无正当理由申请保全给被保全人造成一定损失的行为;包括四种情形:一是无正当理由提起民事诉讼,二是恶意告发,三是滥用诉权,四是无正当理由申请证据或财产保全。加害人的范围包括恶意提起民事或者刑事诉讼的当事人、恶意告发者,还应包括作伪证的证人、虚假鉴定人等其他诉讼参与人。诉讼侵权责任应该适用过错责任原则,并且加害人的过错应该包括故意和过失。在恶意刑事诉讼的赔偿方面,应该协调加害者的民事赔偿和国家赔偿之间的关系。
