Blending reform of tort liability and health insurance: a necessary mix

The thesis of this Article is that making more health insurance benefits available to more people, far from lessening injury victims' proclivity to sue in tort (as conventional wisdom argues), will increase such suits. Thus, it is necessary to accompany any increases in health care coverage with the type of tort reform proposed herein. This reform would allow parties to opt out of the cumbersome and expensive tort claim process with its compensation of noneconomic losses by substituting quicker and surer compensation of any unmet economic losses.     

Foreign Terrorist Fighters: managing a twenty-first century threat

In the aftermath of the Arab uprisings Foreign Terrorist Fighters (FTFs) have emerged as a significant security challenge. Since the 1980s and the Soviet occupation of Afghanistan the notion of a ‘foreign fighter’ has been closely linked, if not synonymous, with those ideologically or religiously motivated individuals who have travelled to join conflicts in Islamic lands. This article will explore the contemporary FTF movement, offering a comparison of Afghanistan in the 1980s and Syria in the contemporary period. It will explore the international community’s expansive responses to the challenge of FTFs, with special focus on the role of the United Nations.     

The shielding capacity of the standard military flak jacket against ballistic injury to the kidney

An animal model was designed to evaluate the ability of the standard military flak jacket to protect the kidneys from direct ballistic trauma. Yorkshire swine were anesthetized and their flanks were protected by flak jackets. Ballistic insults ranging from a low-velocity handgun to a high-velocity rifle were evaluated. The results demonstrate that a flak jacket provides adequate protection against low- and mid-velocity projectiles since none of the animals from this group had evidence of internal trauma and because only minor superficial surgical attention would have been required. Survivability in each case was considered to be excellent. The flak jacket failed to provide any protection against several types of high-velocity bullets. These weapons caused severe internal injury to the genitourinary system as well as to other major organ systems. Survival would have been unlikely.     

The intersection of race and gender: an examination of sentencing outcomes in North Carolina

This study examines the intersection of offenders’ race and gender in the sentencing process using data on felony cases sentenced in North Carolina. Analyses examine the likelihood that charges were reduced in severity between initial filing and conviction, the likelihood of imprisonment, and the length of sentence imposed, and test whether race affects punishment similarly for men and women. Results indicate that status characteristics predict both reductions in charge severity and the severity of the final sentence, and that racial disparity is conditional on gender. However, the results are not entirely consistent with predictions derived from the extant literature. Gender significantly predicts case outcomes at each stage, but black men were not uniformly disadvantaged, and black women received the least severe treatment in two out of four analyses. Theoretical implications for the intersection of race and gender in sentencing theories are discussed.
