This paper addresses the question of why respondents, when asked to specify an income they would be willing to accept as just, settle for an amount that, in most case, does not deviate strongly from what they actually receive. The phenomenon is illustrated by data from West Germany. It is argued that relative deprivation theory must be extended to incorporate processes of social hierarchy perception because inasmuch as this perception is contorted it creates illusory justice evaluations. Empirical evidence of misperceiving social distributions is given by social grading studies based on large German samples. The structural causes of the distributional misperceptions are discussed, one of these causes being the value consensus paradox, i.e., the paradox that, in a stratified society, value consensus will produce different social perceptions.  相似文献

In this paper I return to the issue of incentives to justify a narrowing of the applicability of a fair price rule to contracts of necessity. It is argued that such contracts should be viewed as part of a set of ex ante choices, one of which will minimize the costs of dealing with the risks associated with a period of temporary necessity. The Pareto optimality of a contract of necessity depends on whether the contract price would be seen by a potential victim of necessity as optimal ex ante, relative to her other choices with which to deal with the risk. It is shown that in the special case of a discrete choice set a fair price rule of law may not lead to efficient behavior on the part of both agents.  相似文献

The study proposes a taxonomy that maps and organizes various normative (ought) and empirically oriented (is) theories of distributive justice, with the aim of examining possible relations between these two research traditions. The taxonomy distinguishes between theories according to two shared dimensions of content: (a) microjustice versus macrojustice principles and (b) the unidimensional versus multidimensional character of these principles. The combination of these dimensions yields four groups of theories of distributive justice: unidimensional macro (the utilitarian approach); multidimensional macro (Rawls' theory of justice); unidimensional micro (desert and equity theories); and multidimensional micro (Miller's theory and the multiprinciple approach). A fifth group of hybrid theories is identified (including Walzer's and Jasso's theory of justice), which is built upon the layers of the other taxonomy cells, combining elements of macro- and microjustice and emphasizing the multidimensional character of distributive justice. The analysis revealed that the empirical and normative traditions have much in common. In certain cases, as with the utilitarian approach and Rawls' theory, empirical research has sought correspondence between the ought and the is. In other cases, such as with equity theory and the multiprinciple approach, it has used some basic normative ideas and assumptions as its starting point. Nevertheless, these research traditions often develop in parallel ways without sufficient mutual recognition or interaction. The study concludes by considering possible exchanges that may develop between these two traditions, examining to what extent and how philosophical–normative and empirically oriented research can contribute to one another.  相似文献

Justice theories distinguish between fair procedures and fair or favorable outcomes. However, it is not clear whether people can clearly separate judgments about procedures from knowledge of the outcomes of those procedures. Two experiments are reported which address that question. In both studies respondents evaluate the fairness of decision-making procedures. In one case those evaluations occur prior to knowing the outcome of the procedure (behind the veil), while in the other the outcome is known before the procedural evaluation (in front of the veil). Two hypotheses about outcome influence are tested: that knowing the outcome changes themeaning of procedural fairness and that knowing the outcome changes theweight given to procedural fairness. Findings of both studies suggest that prior knowledge about the outcome does not change the way people define the meaning of the fairness of a procedure. However, people place less weight on their judments about procedural fairness when evaluating the decision maker if they make those judgments already knowing the outcome of the procedure.  相似文献

Two experiments were conducted in which 176 listeners heard male and female objectively defined high- and low-recognition voices and then attempted to identify these voices from a voice parade containing 20 distractors after either 10, 40, 100, or 130 minutes (experiment 1), or 10 minutes, one day, seven days, or 14 days (experiment 2). In experiment 1 delay had no overall effect, although further analysis revealed that the shortest delay did produce better performance than all other delay conditions. Further, high-recognition voices were better identified than low-recognition voices. In experiment 2 delay had an overall effect, with the shortest delay interval again being significantly better than all other conditions, which did not differ among themselves. High- and low-recognition voices, however, did not exhibit a statistically significant difference, although these two factors entered into a marginally significant interaction. Theoretical speculation and forensic implications were drawn.This research was funded by the British Home Office, research grant no. This paper gives the author's impressions on the following aspects of justice: desert, equity, equality, need, and intergenerational equity. The author concludes that these different aspects cannot be reconciled but instead must be compromised. An example of such a compromise is provided by a discussion of welfare reform. The author claims that rights are correlative with duties, and that asserting the former has little meaning without specifying the latter. He then discusses justice toward groups rather than individuals. He proposes that maintaining cultural variety in the presence of a homogeneous superculture is a major problem of the contemporary world. The paper concludes with a discussion of various forms of power, particularly the integrative power that people acquire over each other by virtue of ties of loyalty and identity.  相似文献

So-called three strikes and you're out sentencing laws for criminal offenders have proliferated in the United States. The laws vary considerably in their definitions of what constitutes a strike. This paper adapts the classic Poisson process model of criminal offending to investigate how varying sentence lengths and definitions of what constitutes a strike affect the effectiveness and cost-effectiveness of these sentencing laws. In particular, it asks whether, by using different definitions for the first, second, and third strikes or different sentence lengths, one can make the resulting incarceration more efficient in the sense of incapacitating more crimes per cell-year served.  相似文献

Equity and efficiency are usually regarded as the main objectives of tax policy. Commenting on Dr. Reginald Hansen's doctoral dissertation, the author analyses the meaning of the equity-efficiency trade-off framework in the context of the ongoing debate regarding the reform of the German income-tax system. Schmoller's and Wagner's contrasting conceptions of income taxation are discussed. The role of the tax law as an instrument of interventionism within the framework of the social market economy, especially through the use of tax incentives, is highlighted. Contrary to Dr. Hansen, the author adopts an Austrian viewpoint and argues that both the (catallactic) efficiency and equity of tax incentives are disputable, especially but not uniquely through their (ab)use in tax shelter constructions.  相似文献

A view of organizations as social contracts recognizes self-interests of individuals but does not explain the occurrence of unselfish contributions such as are denoted by organizational citizenship behavior (OCB). We propose that the concept of fairness, as applied to systems of relational contracts, provides a high-leverage construct for understanding the fusion of self-interest and self-denial. A review of the empirical literature suggests that fairness, rather than job satisfaction, accounts for OCB; and that the evidence points toward procedural and interactional fairness as both empirically and conceptually critical in the fairness-OCB relationship. However, we explain why distributive fairness still should not be deemphasized.  相似文献

Considerable attention in the popular and professional literature has focused on the relative costs and benefits of using public protectionist versus civil libertarian models of social control. In this article, we develop statistical analogs of these models to predict violent behavior among samples of defendants found incompetent to stand trial in New York State. The societal and personal costs (errors of prediction) of each model are compared and their implications for clinical practice and social policy are discussed.This research was supported in part by PHS Grant MH 20367 from the NIMH Center for Studies of Crime and Delinquency. Experiment 1 was a Japanese replication of the studies reported by Messicket al. (1985) and Liebrandet al. (1986). Subjects were asked to write down fair or unfair behaviors that they or others did, giving as many examples as possible in 5 min. As in the previous studies, the subjects began more fair behaviors with the word I than with others. Likewise, they began more unfair behaviors with the word others than with I. In Experiment 2, 80 examples of behaviors (40 fair and 40 unfair) were selected randomly from the results of Experiment 1. The difference between the number of frequent behaviors sorted into the fair/I category and that sorted into the unfair/I category was greater than that between the number of behaviors sorted into the fair/others and that sorted to be unfair/others. Salient behaviors were more likely to be sorted into the category of unfair than into fair, and more likely to be sorted into others than I. On the whole, the egocentric bias of fairness was confirmed in Japan as well as in the Netherlands and the United States. However, in both experiments, gender differences were found; women, compared to men, recalled more others' behavior than their own and were likely to attribute fair and/or unfair behavior to others rather than to themselves.  相似文献

The interrelatedness of procedural and distributive justice has implications for organizational practice, especially in the area of performance appraisal. I explore these implications by first describing how procedures can influence perceptions of distributive justice: Procedural improprieties can bring to mind the possibility that a more just outcome might have been obtained if only more acceptable practices had been followed. Next I discuss a second form of interrelatedness — how distributive consequences can influence perceptions of procedural justice — by suggesting that the fairness of a procedure can be assessed in terms of its expected-value (typical or most probable) outcome. These points are illustrated by a discussion of howvoice, or the opportunity for employees to contribute information during the performance appraisal process, can affect both appraisal accuracy and perception of fairness.  相似文献

We investigated the influence of information legitimizing the means—or decision procedures—versus information legitimizing the ends—or the decision outcome—on observers' reactions to an undesirable organizational decision. One hundred and sixty-one employees read an account of a company layoff occurring in a nearby city. The content was experimentally manipulated, such that participants either (i) did or did not receive information legitimizing the layoff procedures, and (ii) did or did not receive information legitimizing the layoff itself. Furthermore, participants received one of two versions of the manipulations, to assess the generalizability of the results across two operationalizations of the primary independent variables. Whereas both information legitimizing the means and information legitimizing the ends were necessary (and neither sufficient) to mitigate observers' judgments of outcome unfairness, procedural information was necessary and sufficient to influence evaluations of the organization. Overall, the data are consistent with the notion that the effectiveness of managerial accounts might be determined not only by information explaining why but also information explaining how decisions are made.  相似文献

The main aim of this paper is to challenge the validity of the distinction between legal justice and social justice. It is argued that what we usually call legal justice is either an application of the more fundamental notion of social justice to legal rules and decisions or is not a matter of justice at all. In other words, the only correct uses of the notion of legal justice are derivative from the notion of social justice and, hence, the alleged conflicts between criteria of social and legal justice result from the confusion about the proper relationship between these two concepts. Two views about the social justice/legal justice dichotomy are of particular importance and will provide the focus for the argument: this dichotomy is sometimes identified with a classical distinction between distributive and commutative justice and sometimes with the distinction between substantive and procedural justice.  相似文献

Conclusions When Manu met MS is a story told to explain the origins of the dhammathats. This is where the text came from implies the corollary ... and that is why we must obey the contents of the text. The special feature of this story, which rendered it unsuitable for inclusion in our Postcanonical Adventures survey, is that MS shares equal billing with Manu. This article argues for the vulnerability of managerial work to unintended forms of racial and other bias. Recent insights into implicit social cognition are summarized, highlighting the prevalence of those mental processes that are relatively unconscious and automatic, and employed in understanding the self and others. Evidence from a response-time measure of implicit bias, the Implicit Association Test, (IAT; Greenwald, McGhee, and Schwartz, 1998) illustrates this phenomenon. Recent work on the predictive validity of the IAT demonstrates that social cognitive pitfalls threaten a) managers' explicit commitments to egalitarianism and meritocracy and b) managers' performance in their three primary roles of processing information, interacting with others, and making decisions (Mintzberg, 1973). Implicit bias influences managerial behavior in unexpected ways, and this influence is heightened in the messy, pressured, and distracting environments in which managers operate.  相似文献

The paper probes the deep structure of perceptions of AIDS and the ensuing public policy trends. AIDS has become the latest symbol indexing 20th century conflicts over the family and sexuality and recapitulates some features of early debates over contraception and the control of sexually transmitted diseases. From 1981 to 1983, public talk about AIDS was virtually taboo. Since 1983, the massive proliferation of AIDS discourse has led to the development of an official story common in the press and clear in the presumptions underlying recent state policies in the United States, Canada, and the United Kingdom. These policies have favored state control of sexual speech and education, as well as control of people blamed for HIV infection, while community-based groups have sought to empower people to affirm their sexuality while avoiding viral transmission.  相似文献

A laboratory study was conducted to examine the role of two components of participatory work evaluation procedures on fairness attitudes and work performance. Opportunity for influential opinion expression and knowledge of evaluation criteria were manipulated in a business simulation exercise. Thirty-eight male and 49 female undergraduates worked under a task evaluation procedure that either did or did not allow them to express their opinions to the evaluator. In addition, subjects either were or were not provided with specific information about the criteria to be used in making the performance evaluation, and they received either a favorable or an unfavorable outcome. Questionnaire responses indicated that influential opinion expression enhanced perceptions of procedural and distributive fairness independently of the outcome of the evaluation. Both knowledge of evaluation criteria and perceptions of evaluation fairness correlated with subsequent task performance. The implications of these findings are discussed with respect to understanding the influence of procedural justice on attitudes and task behavior in organizational settings.  相似文献
