Referendums are often criticised for being elite‐controlled and undeliberative. This article argues that the detailed, multiactor regulation of the Scottish referendum resulted in an elaborate legal regime which helped to overcome these potential pathologies, diluting executive control and facilitating an exercise in national public engagement. It addresses the troubled history of referendum use in the UK and contends that the Scottish process may well transform how referendums are now viewed. Indeed, one outcome of the Scottish process is likely to be a greater demand at UK level for the use of direct democracy in processes of significant constitutional change. It is by no means certain, however, that these demands for greater popular engagement in the process of constitutional change will be met, particularly when we consider the Smith Commission process, which marks a return to elite interparty bargaining.  相似文献

Concern about political disengagement is prevalent in British politics, and this article seeks to examine what the Westminster Parliament has been doing to address it. Recent reforms and recommendations from various parliamentary committees are examined, including increased use of the Internet to disseminate information about Parliament, the use of online consultation mechanisms, and the tentative extension of parliament's petitioning processes. The discussion is couched in the representative origins of Parliament, its adaptation to democratic politics and the extent to which its response to political disengagement is contextualised by its representational, rather than its democratic, role. The article addresses whether Parliament can approach these issues in a 'holistic' fashion, and as a 'unified' institution within the political system.  相似文献

The boundaries of democracy are typically defined by the boundaries of formal status citizenship. Such state-centered theories of democracy leave many migrants without a voice in political decision-making in the areas where they live and work, giving rise to a problem of democratic legitimacy. Drawing on two democratic principles of inclusion, the all affected interests and coercion principles, this article elaborates this problem and examines two responses offered by scholars of citizenship for what receiving states might do. The first approach involves expanding the circle of citizenship to include resident noncitizens. A second approach involves disaggregating the rights conventionally associated with citizenship from the legal status of citizenship and extending some of those rights, including voting rights, to resident noncitizens. This article argues that both approaches fall short of satisfying the democratic principles of inclusion, which call for enfranchising individuals not only beyond the boundaries of citizenship but also beyond territorial boundaries.  相似文献

Since it came to power, New Labour has introduced a range of new electoral system into the British political system, implicitly accepting the argument that Britain's traditional electoral system - first-past-the-post (FPTP) - has been a cause of voter disenchantment with Britain's representative democracy. In this article, it is asserted that Labour's reforms have merely compounded this problem, while demonstrating that all electoral systems have significant flaws. Indeed, it is argued that the flaws of the new systems are more serious than those of FPTP and threaten an even greater disconnection between UK politicians and the people they represent."  相似文献

The decision to leave the EU provoked the biggest constitutional crisis of recent British history. The referendum—a device for circumventing the parliamentary process—was followed by conflict between a minority government and a majority of MPs unwilling to leave the EU without satisfactory alternative arrangements. The courts, drawn into this conflict, upheld conventions that sustain the authority of Parliament and restrain the despotic power of ministers. The reaction of members of the current government was to take disreputable and anti-democratic positions against both the Speaker of the House of Commons and the courts. They now have a sufficient majority in Parliament to resume adherence to constitutional conventions and restore a political culture of debate and tolerance, but they show little sign of doing so, and there is a risk that they will do irreparable damage to the political culture that underpins democracy.  相似文献

The U.S. is one of only a few democracies in the world never to hold a national referendum. Recent national surveys reveal that a majority of respondents approve of a national referendum both cross-nationally and in America is relatively stable. Building on previous work (Bowler and Donovan, 2007), we find public opinion on a reform proposal is fluid and responsive to electoral politics, rather than stable as reported in earlier work. In this paper, we argue that contemporary support for a national referendum in the U.S. is contingent on whether a citizen is a short- or long-term “winner” or a “loser” when it comes to electoral politics. We expect that public support for a national referendum in the U.S., where legislation referred by Congress would be subject to a popular vote, may vary at the individual level because of short-term electoral fortunes as well as long-term structural conditions. Strategic voting as well as losing in candidate races and policy issues may be important, but so might be partisanship, with non-partisans the most likely to benefit from citizen law-making at the national level. Support for a national referendum might also be contingent upon state context, that is, upon use of direct democracy in the state where a person lives, as well as the population of a state. The results based on a natural experiment and 2008 panel survey data provide an important window into understanding public opinion on institutional change more broadly.  相似文献

Abstract

Democracy and tragedy captured a delicate poise in ancient Athens. While many today perceive democracy as a finite, unquestionable and almost procedural form of governance that glorifies equality and liberty for their own sake, the Athenians saw it as so much more. Beyond the burgeoning equality and liberty, which were but fronts for a deeper goal, finitude, unimpeachability and procedural norms were constantly contradicted by boundlessness, subversion and disarray. In such a world, where certainty and immortality were luxuries beyond the reach of humankind, tragedy gave comfort and inspired greatness. The purpose of this article is to draw explicit links between democracy, tragedy and paradox. Given that tragedy's political ascendancy coincided with the birth of democracy in ancient Athens, we may assume that democracy was somehow, if not implicitly, tragic. But what was it that made democracy and tragedy speak so intimately to each other and to the Athenians who created them? The answer, at least the one which this article entertains, is paradox.  相似文献

The title of this article is taken from the opening lines of Hugo Young's brilliant history of Britain's relationship with Europe, This Blessed Plot . That book begins with a sentence that says it all: 'This is the story of 50 years in which Britain struggled to reconcile the past she could not forget with the future she could not avoid.' Those words were written in the spring of 1998. Despite the early promise of Tony Blair's European policy, little has changed since. For France and Germany, the institutions of Europe represent a uniquely successful attempt to exorcise the past. For its part, Britain lives in the shadow of its history.
The struggle to reconcile national identity with strategic interests is as acute as it has ever been. For all that Mr Blair's government has done something in recent years to make Britain's case in Europe, it has failed to make Europe's case in Britain.  相似文献

The Nordic model has long been admired in Scotland, and has featured prominently in aspects of the Scottish independence referendum debate. This article explores the difficulties in instituting a similar system here, identifying two significant barriers: the institutional setting (the powers available to Scottish politicians) and the partisan nature of competition between the two parties that might be able to deliver upon such a commitment. It concludes that the prospects of moving towards a Nordic‐style social investment model are slight, given the political, institutional and attitudinal barriers in place.  相似文献

Democratic citizenship, as it exists in countries like Australia, is premised on a nation-state that has sovereignty over a specific territory demarcated by internationally agreed boundaries. According to this model, citizens are supposed to control the state through democratic processes, and the state is supposed to control what happens on its territory and to decide who or what may cross its boundaries. But today globalization is eroding the capacity of the nation-state to control cross-border flows of finance, commodities, people, ideas and pollution. Powerful pressures are reducing state autonomy with regard to economic affairs, welfare rights and national culture. This leads to important questions: Does the quality of democratic citizenship remain unchanged? Are citizens still the source of political legitimacy? Do we need to rethink the meaning and mechanisms of citizenship to find new ways of maintaining popular sovereignty? How can citizens influence decisions made by global markets, transnational corporations and international organizations? These are problems that all democratic polities face, and Australia is no exception. Political and legal institutions derived from the Anglo-American democratic heritage have worked well for a century and more, but they may need to change significantly if they are to master the new realities. The central question in Castles's article is thus: What can we do to maintain and enhance democratic citizenship for Australians in the context of a globalizing world? To answer this question, he examines some of the inherent contradictions of nation-state citizenship, discusses the meaning of globalization and how it affects citizenship and looks at the effects of globalization and regional integration on Australia. He concludes that it is important to improve the quality of Australian citizenship by various measures: recognizing the special position of indigenous Australians and action to combat racism; combatting social exclusion; reforming the constitution to inscribe rights of active citizenship in a bill of rights; and reasserting the model of multicultural citizenship.  相似文献

Despite increasing support for participatory and deliberative principles amongst academics, practitioners and parliamentarians alike, efforts to infuse political systems with more inclusive and consensual forms of debate often founder. This article explores this conundrum by examining institutional reforms through the lens of deliberative democracy. More specifically, we scrutinise attempts to institutionalise forms of civic deliberation within the Scottish political system via the Scottish Civic Forum and the Scottish Parliament's committee system. Our analysis tells the story of how these two types of institutional reform, both designed to facilitate the move towards a more participatory and deliberative model of democracy in Scotland, have fared over a ten‐year period. In turn, this analysis allows us to comment on the ways in which deliberative and parliamentary democracy may be integrated.  相似文献

In the light of current debate on representation, specifically engaging with literature showing how representation is communicatively constituted, this paper empirically shows how exclusion also can be seen as communicatively constituted. The interpretive approach toward communication employed in this study presents new insights on how, for citizens, government communicates its responsiveness, and how citizens' interpretations that arise from these communications make sense. Dutch citizens who evaluate government responsiveness as low were interviewed to explore their views. The respondents evaluate government responsiveness on the basis of a set of engagements with government. These engagements are conceptualized in terms of four types of encounter – forms in which government manifests itself to citizens. By ‘thinking with’ these encounters, citizens relegate institutions and processes of representative democracy to the margins of political reality. Situating citizens outside of democratic politics, these interpretations imply the experience of exclusion, despite apparently functioning democratic institutions and processes.  相似文献

A review of the literature on citizenship shows a trend away from anchoring citizenship practices to the nation-state and a move towards recasting the concept in universal terms. The paper examines this trend by focusing on the writings of Held, Bohman, and Benhabib. It distinguishes their ‘deliberative’ approach to citizenship, and suggests that this leads them to reformulate citizenship in a way which differs little from human rights. Although the paper shares in the view that a move to a human rights politics would pave the way for a more equitable order, it argues that there is also a risk. By drawing on the agonistic perspective on democratic politics, the paper shows that the risk is that we might undermine democratic politics by reducing it to a single principle.  相似文献

The Blair governments since 1997 have seen the single most significant period of constitutional reform in Britain for over a century. However, they leave the monarchy, the institution at the apex of the unwritten constitution, untouched. It is argued that neither inaction nor abolition is advisable, but that reform should be undertaken, with particular attention to the rules of succession and to the royal prerogative powers, notable examples being the powers to declare war, to dismiss parliament, to assent to legislation and to appoint the Prime Minister. Those powers now exercised by the executive should be formally and linguistically separated from the office of head of state, and put on a statutory basis. The achievement of these reforms depends, however, on political will and cannot be initiated by the monarchy itself.  相似文献

Though the link between democracy and an appropriately trained citizen is obvious, the theoretical and empirical nature of this association is murky despite mountains of scholarship addressing this topic. Part of this problem is that the term democratic competence has been stretched almost to the point of uselessness. This constant adding of desired traits—many of which are ideologically driven—misdirects effort away from such complex problems as the relationship between individual attributes and collective capacities. Moreover, recent research has often been guilty of using data of uncertain relevance to demonstrate a competence that seems largely an analytical artifact. We conclude by offering an approach that stresses old- fashioned traits such as patriotism that seem necessary to the existing, and quite democratic, status quo.  相似文献

The purpose of this paper is to provide the definitional and empirical background to the Liberal Democracy Series I Index of democracy that is available in Bollen (1998) but whose rationale has not been published. More specifically, the paper (1) gives a definition of liberal democracy that has guided the formation of this index, (2) describes measures that correspond to this definition, (3) provides a measurement model that links the indicators of democracy to the latent variables that represent the concept, (4) explains the construction of the Liberal Democracy Series I Index, and (5) compares the Series I democracy measure to two other widely used democracy measures in a latent curve model. The Liberal Democracy Series I Index provides a simple unweighted measure of liberal democracy that minimizes the bias in expert ratings, is highly reliable and highly correlated with the latent liberal democracy variable. The evidenced reviewed here suggests that its measurement properties are superior to the Polity and Vanhanen democracy indices with the exception that it is available for a more limited period of years than these latter two.  相似文献
