| 摘 要： | 法治的成效主要不取决于程序内的制度运作事实，而是取决于程序外的反事实性的期望，也即对于法律的信任。法治评估主要是对地域法治水平的一种有意识反思与理论化认知，借用了政府一贯所使用的数字化方式，并极力搜罗法律程序内各种可视化的数字信息。但法治的定量评估很难评价以定性判断为特征的法律信任。法治评估大多情况下只具有管理意义，不具有学术意义。民意调查在法治评估中可以被视为一种对于法治的有意识反思，但其无法传达非反思性的法律信任实践。各种法治评估的信息来源大多局限于地方性与法律相关性的信息，但某一地方的法治水平和公众对其他地方法律的期望与信任是相互关联的，法律信任的信息基础不仅仅来自法律系统，可能还包括其他社会领域。法治评估实际是用线性、同质的数字取代了非连续性的现实，将源于方法论的建构取代了行为的实践依据，这种取代抽空了生活的意义，将一种“伪精确”强加给了现实，从而也很难切入大多数人的法律实践。

On the “False Precision” of the Rule of Law Evaluation |

| Abstract: | The evaluation of rule of law is a kind of conscious reflection and theoretical cognition of the level of regional rule of law.The effects of rule of law are mainly not depend on the facts of institutional operation inside legal procedure,but the counterfactual expectation and trust out of legal procedure,that is the trust in law.The evaluation of rule of law is a kind of conscious reflection and theoretical cognition of the level of regional rule of law,borrows the digital method governments all the time like to use and tries to collect all kinds of visible information in the legal procedure.It is difficult for us to evaluate trust in law characterized by qualitative judgment by the quantitative evaluation of rule of law.The evaluations of rule of law only have management meaning and no academic significance.In the rule of law evaluation,opinion survey can be regarded as a kind of conscious reflection of rule of law,but it can not convey non-reflective practice of the trust in law.The information sources of many evaluations of rule of law are limited to the local information and the information relating to law,but the level of rule of law of a place is associated with the public’s expectation and trust of law of other places and the informational foundation of trust in law not only comes from legal system but also other social fields.The rule of law evaluation substitutes linear and homogeneous number for non-continuous reality and replaces the practical basis of actions with the construction of methodology.These replacements evacuate the meaning of life and impose"false precision"on reality.It is also difficult for them to cut-over the legal practices of most people. |
